Terms of Service

BERNIER is the brand advisory practice within BERNIER GROUP. By purchasing services from BERNIER ("we," "us"), you agree to the following terms. BERNIER FASHION ADVISORY and BERNIER FITNESS ADVISORY are separate practices with their own terms.

1. Services. BERNIER provides a private visual and brand analysis ("the Visual Read"), delivered as a written PDF report and, for applicable tiers, a private video call.
2. Payment. Full payment is required at the time of purchase. All prices are in USD.
3. Delivery. Written Reads are delivered by email within 5 business days of completed intake submission, unless otherwise communicated.
4. Refunds. If you change your mind, you may request a full refund within 7 days of purchase, provided your Visual Read has not yet been delivered. Once your completed analysis has been delivered, the purchase is final, given the personal time and work already completed on your behalf. To request a refund within the 7-day window, email bernier@thebernier.com.
5. Use of AI. Portions of our internal workflow (organizing submitted materials, drafting initial structure) may involve AI tools. Every analysis is personally reviewed, edited, and approved by BERNIER before delivery. The aesthetic judgment and recommendations in your Read are human-authored.
6. Intellectual property. The Visual Read prepared for you is yours to use privately. BERNIER retains the right to reference general, anonymized learnings from our work, but will never share your specific materials or analysis publicly without your permission.
7. Confidentiality. Materials you submit are used solely to prepare your Read and are not shared with third parties beyond the tools necessary to deliver our service.
8. Limitation of liability. BERNIER provides aesthetic and strategic opinions, not guarantees of business outcomes.
